Terms of Service

Effective: April 14, 2026

1. Agreement

These Terms of Service (the “Terms”) form a binding contract between you and SIA Mad Digital, a limited liability company registered in Latvia, operating Trikkl (the “Service”, “Trikkl”). By creating an account, accessing, or using the Service you agree to these Terms. If you are using Trikkl on behalf of a business, you represent that you have authority to bind that business.

2. The Service

Trikkl is a software-as-a-service product for local service contractors. It lets you:

  • Request Google reviews from your customers via SMS
  • Track open quotes and send follow-up messages
  • Set up recurring service rebooking reminders
  • Capture and manage private feedback
  • Run custom messaging campaigns to your own customer list

Availability, features, message limits, and pricing are described on the product pages and pricing page. We may evolve the Service over time, including adding or removing features.

3. Eligibility and accounts

  • You must be at least 18 and have legal capacity to enter a contract.
  • You must provide accurate information at signup and keep it current.
  • You are responsible for keeping your login credentials secure. Activity under your account is your responsibility.
  • One account per business. Multi-technician use is available on eligible plans.

4. Pricing, billing, and cancellation

  • Paid plans are billed monthly in advance through Stripe. Prices are in USD unless otherwise stated.
  • Your first charge occurs after the free trial ends (if applicable) or when you start a paid plan.
  • You can cancel any time from your billing settings. Cancellation stops future charges; it does not refund the current billing period unless required by law.
  • We may change pricing on 30 days' notice. If you keep using the Service after the price change you accept the new price.
  • Failed payments may result in account suspension or downgrade. We will attempt to notify you before this happens.

5. Your obligations when sending messages to your customers

This is the most important section. Read it carefully.

Trikkl sends SMS and email messages on your behalf. US law (the Telephone Consumer Protection Act and CAN-SPAM), Canadian law (CASL), and carrier rules (A2P 10DLC) put legal responsibility for consent on the business that collects the customer's phone number and email address - that's you, not Trikkl. By using Trikkl to message your customers you represent and warrant that:

  • You have obtained prior express consent from each customer to receive SMS and/or email messages from your business.
  • Your consent-capture process clearly explains the types of messages you will send and how to opt out.
  • You will honor opt-out requests immediately. Trikkl also honors STOP/UNSUBSCRIBE globally, but you are responsible for not re-adding opted-out contacts.
  • You will not use Trikkl to send political messages, high-risk financial offers, adult content, unsolicited marketing to non-customers, or any message category prohibited by US carriers.
  • Your A2P 10DLC registration (Brand + Campaign) accurately describes your messaging use case.

If you breach these obligations you indemnify SIA Mad Digital for any fines, legal fees, or damages arising from your messages.

6. Acceptable use

You will not:

  • Reverse engineer, decompile, or attempt to extract source code
  • Share login credentials outside your business
  • Resell or sublicense access to Trikkl without our written agreement
  • Use Trikkl to send spam, harass individuals, or violate any law
  • Use Trikkl to contact people who did not provide consent
  • Submit false or misleading content
  • Circumvent security controls, rate limits, or cost caps
  • Use Trikkl's infrastructure to send cold outreach on your behalf - we offer our own outreach product for that use case

We may suspend or terminate accounts that violate these rules, including without refund in serious cases.

7. Your data and our data

  • You retain ownership of the customer data you upload. You grant us a limited license to store, process, and transmit that data solely to provide the Service.
  • We process customer data as a data processor. See the Privacy Policy for details.
  • We own all intellectual property in the Trikkl product itself - the software, design, UI, the trademark, and the content of our blog, marketing pages, and documentation.
  • Aggregate, anonymized usage statistics (never individual customer records) may be used to improve the Service.

8. Third-party services

Trikkl depends on third-party providers (Twilio, Resend, Stripe, Supabase, Vercel, Google, Anthropic) to deliver messages, take payments, and run the product. Their own terms apply to their portion of the Service. We are not responsible for outages or changes in their services.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”.

To the maximum extent permitted by law, SIA Mad Digital disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any specific message will be delivered.

You acknowledge that SMS delivery depends on carriers and is never 100% reliable. Trikkl is a tool that helps you ask for reviews and manage follow-ups; it is not a guarantee of any specific business outcome, review count, or revenue.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIA MAD DIGITAL'S TOTAL LIABILITY ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

Neither party is liable for indirect, incidental, consequential, special, or punitive damages, including lost profits or lost customers, even if advised of the possibility. This limitation does not apply to your indemnification obligations, your violation of Section 5 (messaging consent) or Section 6 (acceptable use), or to fraud or willful misconduct.

11. Indemnity

You will indemnify, defend, and hold harmless SIA Mad Digital and its officers, employees, and agents from any claim, fine, liability, or cost (including reasonable legal fees) arising from:

  • Your breach of Section 5 (messaging consent) or Section 6 (acceptable use)
  • Your breach of any law applicable to your business
  • Claims from your own customers relating to messages you sent through Trikkl
  • Your violation of a third party's rights

12. Termination

You may terminate at any time by cancelling your subscription and closing your account. We may terminate your account on 30 days' notice for any reason, or immediately if you breach these Terms or if continuing to serve you creates legal or carrier risk.

On termination we will retain data only as long as needed for legal retention, dispute resolution, and fraud prevention. Opt-out flags are retained indefinitely.

13. Beta features

We may mark features as “beta” or similar. Beta features are provided as-is, may be changed or removed at any time, and are excluded from uptime commitments.

14. Governing law and disputes

These Terms are governed by the laws of the Republic of Latvia, without regard to conflict-of-laws rules. The courts of Riga, Latvia have exclusive jurisdiction over disputes, except that either party may seek injunctive relief for intellectual-property infringement or breach of Section 5 or 6 in any court of competent jurisdiction.

If you are a consumer resident in the European Union, nothing in these Terms limits the mandatory consumer protections of your home country.

15. Changes to these Terms

We may update these Terms. For material changes we will give active account holders at least 14 days' notice by email. If you keep using the Service after the effective date of a change you accept the new Terms.

16. Miscellaneous

  • These Terms and the Privacy Policy are the entire agreement between us regarding the Service and supersede prior discussions.
  • If any provision is held invalid, the rest of these Terms remain in effect.
  • Our failure to enforce a provision is not a waiver of the right to do so later.
  • You may not assign these Terms without our consent. We may assign them in connection with a merger or sale.
  • Notices to us should be sent to legal@trikkl.app. Notices to you may be sent to the email on your account.
